Donations

These terms and conditions (as amended from time to time) govern the relationship between you (the user) and us (Whiyou Ltd, Companies House no. 15225246, “Whiyou”, “us”) concerning any donation payment we make to non-profit social enterprises (Charities, Foundations, Community Interest Companies) through our website https://www.whiyou.com

 

By using the Website and our services, you are confirming that you are complying with our 10% donation pledge, and our policies and that you agree to be bound by these terms and conditions.

 

Whiyou Ltd is the parent company of The Hi-Five Club. The Hi-Five Club is currently in the process of becoming a Community Interest Company.

1. Our Agreement with You

​

The 10% donation per product and service use is automatic and you cannot opt out. If you wish to opt out, please refrain from using our services. We have complete discretion over our donation pledge and reserve the right to decline or change the receiver for any reason. The agreement between you and us will be entered into once we have accepted your purchase of any Whiyou product and service.

2. The Donation

​

We will use your donation at our discretion but within our stated charitable objectives of assisting a variety of charitable causes and following our GIVE BACK pledge.

 

2.1 Donation Percentage: Whiyou pledges to donate 10% of its Gross profits to selected charities or community support partners. This percentage is mandatory, and customers cannot opt out of this donation.

 

2.2 Donations Transparency: The total funds donated will be prominently displayed on the Whiyou website. By participating in Whiyou Ltd and The Hi-Five Club, you acknowledge and accept these Terms and Conditions, including the non-negotiable 10% donation commitment and the refund policy. Failure to adhere to these Terms may result in the termination of your participation and other legal actions as deemed necessary by Whiyou.

3. Refunds

​

Upon a successful returns and refund agreement, we will honour a full refund or product exchange. Whiyou Ltd will be responsible for donations. In instances where we believe our company is at risk of being abused, we reserve the right to decline any refunds, partial or otherwise.

 

3.1. Protecting the company: We may refuse product orders and refunds due to, and subject to investigations, and not limited to Whiyou reserving the right to refuse bulk orders that may indicate an attempt to exploit the donation system, such as orders made in an attempt to trigger excessive donations.

3.2. Refusal of Refunds: In cases where a bulk order is placed and subsequently refunded, Whiyou reserves the right to decline any refunds and investigate the circumstances surrounding the bulk order.

4. General

​

This contract is between you and us. No other person shall have any rights to enforce any of its terms.

 

Limitation of Liability: Whiyou shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your participation in Whiyou Ltd and The Hi-Five Club activities.

If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you later.

 

These terms are governed by English law, and you can only bring legal proceedings in respect of the products in the English courts.
